Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the www.asolfood.com website (the “Service”) operated by Asol Food (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

The Asol Food website is intended for your personal, non-commercial use to browse, select, and order grocery products for delivery. You agree not to use the Service for any unlawful purpose or in any way that might harm, disrupt, or impair the Service or its users.

Prohibited activities include, but are not limited to:

• Interfering with other users’ enjoyment of the Service.

3. Ordering and Payment

• Product Availability: All products are subject to availability. We reserve the right to limit the quantity of products supplied. We also reserve the right, at our sole discretion, to discontinue any product at any time.
• Pricing: All prices are listed in Bangladeshi Taka (BDT) and are inclusive of applicable taxes unless stated otherwise. Prices are subject to change without prior notice. The price charged will be the price displayed on the website at the time of order confirmation.
• Order Acceptance: Your order is an offer to buy from us. All orders are subject to acceptance by us. We reserve the right to refuse any order for any reason, including but not limited to product unavailability, errors in product description or pricing, or suspected fraudulent activity.
• Payment: We accept payments through secure third-party payment gateways. By placing an order, you authorize us to charge the applicable amount to your selected payment method. We do not store your full payment card details on our servers.
• Cancellations:
  • By You: You may cancel an order before it has been dispatched for delivery. For specific instructions and timeframes, please contact our customer service team.
  • By Us: We reserve the right to cancel any order if we are unable to fulfill it (e.g., due to stock issues, delivery constraints, or payment problems). In such cases, a full refund will be processed to your original payment method.
• Refunds: Refunds for cancelled or returned items will be processed. Please note that it may take 3 business days for the refund to reflect in your account. For detailed refund procedures, please contact our customer service.

4. Delivery

• Delivery Area: We only deliver to specific areas within Bangladesh. You can confirm if we deliver to your location by entering your address during checkout.

• Delivery Times: We aim to deliver within the estimated time frames provided. However, delivery times are estimates and may vary due to traffic, weather conditions, or other unforeseen circumstances. We are not liable for any delays in delivery.
• Delivery Acceptance: You (or an authorized person) must be available at the delivery address to receive and sign for the order. If delivery cannot be completed due to your unavailability or incorrect address details, additional charges or order cancellation may apply.
• Inspection upon Delivery: Please inspect your order upon delivery. Any issues with damaged or missing items must be reported to our customer service immediately upon receipt of the order.

5. Product Information

We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Service. However, we do not guarantee that the colors, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colors and details of the products. All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reason.

You retain any and all of your rights to any Content you submit, post or display on or through the Service and you are responsible for protecting those rights.

You represent and warrant that: (i) the Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Asol Food, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

10. Limitation Of Liability

In no event shall Asol Food, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

You agree to defend, indemnify and hold harmless Asol Food and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

These Terms shall be governed and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

13. Changes To Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 3 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
